TORKEHUB Automation - Terms of Use
TORKEHUB Automation, a service facilitating the creation, sending, and management of marketing emails and promotional SMS, is provided to you or the entity you represent (referred to as "you" or "your") by TORKEHUB (hereinafter "TORKEHUB"), subject to the following terms and conditions (hereinafter "Terms") in addition to TORKEHUB's General Terms of Service. Your use of TORKEHUB Automation indicates your acceptance of these Terms and the General TORKEHUB Terms of Service. If you do not agree to these Terms, refrain from proceeding or using TORKEHUB Automation in any manner.
TORKEHUB Automation - Service Overview
TORKEHUB Automation is a comprehensive system designed to facilitate the creation, sending, and management of marketing emails and promotional SMS, along with robust contact list management capabilities. This system empowers you to efficiently build and manage your contact lists through various methods, including embedding subscription forms, importing contacts from Customer Relationship Management software, or integrating with other contact databases.
Accessing TORKEHUB Automation
TORKEHUB Automation may be integrated with other TORKEHUB services to enhance your marketing capabilities. Your TORKEHUB account grants access to all TORKEHUB services, even those not directly integrated with TORKEHUB Automation. However, certain TORKEHUB services may have specific terms of service (referred to as "Service Specific Terms"), which must be accepted before using those services.
Integration with Other TORKEHUB Services
TORKEHUB Automation may be integrated with other TORKEHUB services to enhance your marketing capabilities. Your TORKEHUB account grants access to all TORKEHUB services, even those not directly integrated with TORKEHUB Automation. However, certain TORKEHUB services may have specific terms of service (referred to as "Service Specific Terms"), which must be accepted before using those services.
Usage Restrictions
By utilizing TORKEHUB Automation, you agree to abide by the following usage restrictions:
You will not send marketing emails and/or promotional SMS that infringe upon intellectual property rights or other proprietary rights, contain defamatory or offensive content, promote hate speech or discrimination, include pornographic or obscene material, impersonate individuals or entities, or violate any applicable laws.
Marketing emails and promotional SMS will not be sent to promote illegal or counterfeit products, pharmaceuticals, gambling services, or other prohibited activities.
You will not engage in spamming activities, such as pyramid schemes, affiliate marketing, or click fraud.
Surveys, contests, charity requests, or chain letters will not be conducted or forwarded via TORKEHUB Automation.
TORKEHUB Automation will not be used to promote dangerous or illegal activities, including those related to cryptocurrency.
Links to sites involved in prohibited activities will not be included in marketing emails or promotional SMS.
TORKEHUB Automation will not be utilized for providing warnings or notifications about risks to personal safety or property.
Anti-Spam Policy
When sending marketing emails or promotional SMS through TORKEHUB Automation, you must comply with TORKEHUB's Anti-Spam Policy and all applicable laws, including the CAN-SPAM Act and similar regulations governing commercial communications. Additionally, you may only send emails or SMS to contacts obtained through acceptable means, as outlined below:
Contacts obtained through website downloads, purchases, or form submissions.
Subscribers who have opted in to receive marketing communications through email or SMS.
Participants in contests, events, or surveys who have provided their contact information.
Contacts who have explicitly consented to receive commercial communications through email or SMS.
Contacts who have provided business cards indicating a willingness to receive commercial emails or SMS.
Referred contacts from existing customers or subscribers who have consented to receive marketing communications.
Consent must be obtained from contacts before sending commercial emails or SMS, and sender information must be clearly provided in all communications.
Email Campaigns
In addition to the above terms, the following conditions apply to the use of Email Campaigns:
Sender information must be included in every email, providing contact details and registration information.
TORKEHUB reserves the right to monitor and review Email Campaign content to improve deliverability and detect spam.
Usage may be throttled if Email Campaign thresholds for bounces, complaints, or unsubscribes are exceeded.
SMS Campaigns
For SMS Campaigns, the following terms apply:
TORKEHUB may monitor SMS content and traffic patterns to ensure compliance with the Terms.
Suspension or termination of SMS Campaigns may occur if violations are detected or if usage limits are exceeded.
Violations and Modifications
Violations of the Terms may result in suspension or termination of your TORKEHUB Automation account. TORKEHUB reserves the right to modify the Terms of Use, with such modifications becoming effective upon your continued use of TORKEHUB Automation.
